FAQ: Choosing the Right Lawyer   no comments

Posted at 9:22 pm in Articles

FAQ: Choosing the Right LawyerTo sum up our three part series in which we answer the most frequently asked questions about topics related to law, we decided to answer some of the most frequently asked questions about how to choose the right lawyer.

1. Can I represent myself and use a lawyer only for advice?

Yes, you can. However, you need to let your lawyer know about it before you hire him (not all lawyers are willing to work this way). Representing yourself is a good way to learn practical legal skills, but it isn’t necessarily a good idea if you aren’t willing to spend a lot of time on the case.

2. How to conduct a background check?

Before you hire a lawyer, make sure that he’s in good standing with local bar association. You should always check references and search for online reviews. Another good way to review a lawyer is to visit Martindgale.com website and check a lawyer’s peer review ratings there. Martindale-Hubbell Law Directory is one of the best places to find information about the best law firms and lawyers in countries all over the world.

3. What questions should I ask during the interview?

There are dozens of questions that will help you assess a lawyer’s legal ability). Here are some of the most important ones:

  • what experience do you have in my type of case?
  • how long have you been in practice?
  • what are your fees and how often will you bill me?
  • do you carry malpractice insurance?
  • who else would be working on my case with you?
  • do you outsource any part of your work to someone else?
  • can you provide references from other clients?
  • how often will you inform me about any changes with my case?

Asking all these questions will help you make an informed decision. Take your time before you make the final decision. Good luck!

FAQ: Business Protection   no comments

Posted at 9:22 pm in Articles

In our second post from our FAQ series we will answer some of the most common questions about business protection. Read the answers to these questions to educate yourself about how to protect your business from lawsuits!

1. Should I get business insurance?

You should get business insurance before you start providing services or selling products. Without insurance you’re very exposed. Just imagine that a client sues you because he broke his leg at your property. He can easily sue you for $20,000 or more. Can you afford to pay this amount of money when you’re just starting out with your business? Get business insurance (ask for business owners’ policy for the best deal that will protect you in most cases) and stop worrying about lawsuits – your insurer will cover any legal costs and eventual compensation in case someone sues you.

2. What else should I do to protect my business from lawsuits?

We published two articles with tips on how not to get sued in business. Some of the most important tips include putting everything in writing, keeping your employees and customers happy and choosing the right business structure. Ask your lawyer for additional tips that will increase your legal protection.

3. What should I do if someone sued my company?

Contact your insurance company. They will find a lawyer for you who will defend you. In case you lose the case, your insurer will cover all your costs. If you don’t have insurance… well, you need to hope that your lawyer will get you out of trouble.

4. Which types of business insurance are the most important?

If you’re a freelancer, it’s professional indemnity insurance (also known as professional liability insurance or errors and omissions insurance). If you have a pub, restaurant, store, etc., public liability insurance is the most important type of insurance for you.

FAQ: Personal Injury   no comments

Posted at 9:21 pm in Articles

In the next three articles we will answer some of the most common legal questions. Today we will focus on personal injury, in our next article we will answer most frequently asked questions about business protection and in our last post from this series we will answer some of the most common questions about finding the right lawyer. Without further ado, here are some of the most common questions about personal injury:

1. How much is my personal injury claim worth?

Ask your lawyer to look for past cases similar to yours. They will give you a rough estimate. A professional lawyer will be able to estimate the worth of your claim when he reviews your medical bills, documentation, severity of your injuries and your personal attributes.

2. Where can I find a personal injury lawyer?

The best way to find a personal injury lawyer is to ask for referrals. If you don’t know anyone who can recommend a personal injury lawyer to you, call state bar association. You can also visit nolo.com and search through their directory of lawyers. There are quite a few of similar websites online – take the advantage of them and use their directories to find a lawyer who will be the best fit for you.

3. Should I settle with an insurance company on my own?

Some insurance companies will offer you a settlement a short time after the accident. If you haven’t talked with a lawyer yet, don’t even talk to the insurance company. They can use everything you say against you. Don’t be naive as for the settlement right after the accident – it won’t be a fair settlement, and you’ll be able to get much more money if you hire a personal injury lawyer who knows what to do to make the insurance company offer a fair settlement.

How Not to Get Sued in Business (Part 2/2)   no comments

Posted at 9:17 pm in Articles

Today we will share with you additional tips on how not to get sued in business. Follow our advice to reduce your risk of being sued!

1. Keep accurate financial records

Don’t do accounting on your own. Find an accounting company that will record all your financial transactions. If the authorities have any doubts about your financial management, they can freeze your accounts. Avoid this risk by hiring a professional accounting company and hiring an independent auditor every couple of years.

2. Never ignore complaints

Keep your customers happy, and you’ll avoid most lawsuits. If you ignore complaints of your clients and/or your employees, you can find yourself in court quite soon. If your customer is unhappy with his purchase or services that you provided to him, it’s better to refund him the money than argue with him and risk being sued (a lawsuit will be always more costly than a refund).

3. Get insurance

Business insurance is one of the most effective ways to protect your company against lawsuits. If someone sues you, your insurer will cover all your legal costs. Insurance isn’t cheap, but it offers protection that will help you sleep well at night knowing that you’re not one lawsuit away from bankruptcy. Please keep in mind that malpractice cases can be easily worth more than $100,000 – can you afford paying such amounts of money out of your own pocket? Get business insurance today – ask your insurance agent about public liability insurance and professional indemnity insurance as well as any other types of insurance suitable for your needs.

Please keep in mind that there are more and more lawsuits, and many small businesses are very exposed to such costly and time-consuming practices. That’s why you should invest in business insurance and keep in touch with a good lawyer. Learn more about lawsuit abuse from the video below:

How Not to Get Sued in Business (Part 1/2)   no comments

Posted at 9:12 pm in Articles

If you don’t want to get sued in business (and who wants to get sued?), you should read our today’s blog post. Today and in our next blog post we will share with you some of the most important tips that will help you and your company avoid being sued.

1. Choose the right business structure

While sole proprietorship is the most common and simplest business structure, it’s also the most dangerous in terms of legal risks. If someone sues your company, he sues you (because the business is the owner). A limited liability company is one of the best choices for start-ups. It provides more legal protection and is still quite easy to set up. Corporations provide the most protection, but they are quite difficult to set up and there are more operating costs (because of additional accounting).

2. Put everything in writing

It’s one of the most basic, yet one of the most powerful pieces of advice. You should put every business transaction (even a very small one) in writing – all contracts, agreements, financial transactions, etc. If you have no idea how to create such documents find a lawyer and ask him to prepare sample documents for you – you’ll be able to use them for all business transactions. However, your legal documents should be simple and easy to understand. If you have no idea what your contract says, your client or sub-contractor doesn’t know, either, and it will be difficult to enforce it.

3. Prepare simple policies for your customers

Your policies should be as easy as possible. If you own an online store, create a simple refunds and returns policy. If your customers have a hard time understanding your policies, they won’t be eager to buy from you.

How to Interview the Prospective Lawyer?   no comments

Posted at 9:11 pm in Articles

Before you hire a lawyer, you should talk with him personally (schedule a free consultation) so that you can size him up and make an informed decision. There are many things to look for when searching for a good lawyer. Below are some of the most important ones:

1. Personality

If you have a complex case, it will take at least several months to settle it. Personality of the lawyer you’re going to work with is very important. If you feel uncomfortable around him or her, you shouldn’t hire him regardless of how many people recommended him or her to you or how much experience he has with cases such as yours. Personal chemistry is very important to achieve a good lawyer-client relationship.

2. Communication

One of the most important skills any lawyer should have is social skills and communication skills. If it’s very hard to reach your lawyer whenever you have a problem, you’re going to lose sleep and time. Make sure that they lawyer you want to work with is very easy to reach, that you won’t have to wait several days to meet with him or her and that he will start working hard on your case from the beginning. A good lawyer will keep you updated about your case and let you know what he’s working at on a regular basis.

3. Experience

Last but most definitely not least, experience is very important. If you want to win the case, you should find an experienced lawyer who had cases similar to yours. He’ll be able to review your case quickly, know exactly what steps he needs to take to settle it quickly and will let you know very soon how much your case is worth (in case of personal injury claims).

Take your time when looking for a lawyer. Good luck!

What You Need to Know About Personal Injury Lawyers   no comments

Posted at 9:09 pm in Articles

LawyerPersonal injury lawyers can help you receive a fair settlement in case you decide to pursue a personal injury claim. What should you know about personal injury lawyers?

First and foremost, you should keep in mind that while they only get paid if your case is successful, you’ll still have to cover any other legal costs and fees so you can’t sue someone if you have absolutely no money. In some countries if you win the defendant will have to cover these costs for you but you should still keep in mind that suing someone isn’t completely free.

Secondly, personal injury lawyers may specialize in different types of personal injury law. There are many types of personal injuries and each one requires different knowledge. For instance, there are personal injury cases as a result of car accidents, slip-and-fall cases, libel and slander cases, malpractice cases, etc. Each one requires expertise in a different field of personal injury law. If you have a very complex case, you should consider working with a law firm in which several lawyers will work on your case. Each lawyer specializes in a different type of personal injury law which means that they can handle your case much more quickly than an independent lawyer.

Thirdly, please remember that personal injury lawyers who you can easily find in Google aren’t necessarily the best lawyers in your area. Many experienced personal injury lawyers don’t even have websites because they have to many clients by referrals. That’s why it’s a good idea to ask for referrals your friends, family, colleagues, business associates, local bar associations, etc.

Last but not least, most personal injury lawyers offer a free consultation that will help you make a decision whether you should hire the lawyer you were considering or keep looking for another attorney.

Personal Injury Claims 101   no comments

Posted at 9:08 pm in Articles

You have a personal injury claim when you suffered an injury (and had to cover medical bills) because of someone else’s negligence. You can sue the party responsible for your injury to get compensation for your expenses, lost income, pain and suffering, emotional distress, etc.

Personal injury claims are one of the most common claims that usually end in a settlement before going to court. If you want to pursue a personal injury claim, you should keep in mind that it’s a very complex task and you will have to hire a lawyer. The good news is that personal injury lawyers work on a contingent-fee basis which means that they only get paid if the case is successful. This means that if you don’t have money for a lawyer you can still hire a personal injury lawyer (if he decides to take your case).

Personal injury claims, especially medical malpractice cases, are usually worth a lot of money, and sometimes can even exceed $500,000. A typical personal injury lawyer will take around 30% of your recovery. It seems like a lot of money, but keep in mind that you probably won’t be able to receive even half of the final amount if you were to handle the case on your own (unless you’re a lawyer).

If you’re a business owner, you should protect your company against personal injury claims and buy public liability insurance, product liability insurance and professional liability insurance. These three types of insurance will protect you against most types of personal injury claims. You can also consider other types of business insurance – ask your insurance agent for a business owners’ package.

Nowadays personal injury claims are very common and many lawyers specialize in this type of law. However, you should always look for a lawyer who specializes in one field of personal injury law, e.g. car accidents.

Where to Find a Lawyer For Your Case?   no comments

Posted at 9:07 pm in Articles

If you have a complex legal problem, you should seek professional help. There are many ways to look for a lawyer, but only several of them will help you find a lawyer that will be surely a good fit for your case. Here they are:

1. Personal referrals

Talk to people who you know and ask them for referrals. If you talk to a few people who had similar legal problems as you, you will quickly find a lawyer that will be a good fit for you and your case. 2. Online services

There are many independent websites that offer a way to connect with local lawyers. One of the most well-known such sites is Nolo.com with a very extensive lawyer directory. You can browse through profiles on your own and seek the best lawyer by reading about his experience, education, fees, philosophy of practicing law, etc. You can also ask for a recommendation. You will have to provide a few answers about your case and the right type of lawyers will contact you.

How to Choose the Right Lawyer?   no comments

Posted at 9:48 pm in Articles

Hello! We decided to start this blog to share with you useful information about how to choose the right lawyer. We will also share with you useful information about law-related topics.

Today we want to share with you several most important tips on how to choose the right lawyer.

1. Ask for referrals

Most very experienced and professional lawyers don’t advertise their services anywhere. They already have a client base and they don’t need to look for more clients – new clients come to them by referrals. If you want to find the best lawyer, asking for referrals is definitely the best way to go about it. Lawyers that appear in Google may have a lot of money for marketing, but they aren’t necessarily the best lawyers.

2. Consider several lawyers

Most lawyers offer a free consultation. Take the advantage of free consultations to assess several lawyers and only then choose the best one for you and your case. You should always compare at least several lawyers because each lawyer has a different style, personality, experience, rates, etc.

3. Make a list of questions to ask

One of the most important things that you can do to screen a lawyer is to make a list of most basic questions that you want to ask him. You should ask about his experience (ask him if he ever had cases similar to yours), credentials (does he belong to any well-known associations?), style (does he prefer settlements or is he aggressive?), and his ethics. The more you know about your lawyer, the easier it will be to work with him. Don’t underestimate the importance of personality – if you have a complex case, you’ll have to spend many hours with your lawyer so it’s good if you actually like him.
